31 DecFuneral for NYPD officer shot in botched robbery

Thousands of police officers from New York and New Jersey gathered at a small Long Island church Monday to honor a New York Police Department patrolman shot to death during a botched robbery in Brooklyn.

Officer Peter Figoski was remembered as a dedicated worker ? a 22-year veteran with 12 medals and more than 200 arrests ? and loving father of four daughters: Carolyn, 16, and Corrine, 14, both in high school, and Christine, 20, and Caitlyn, 18, who are in college upstate.

“Christine, Caitlyn, Caroline, Corrine, as the father of daughters, I understand the bonds you share with your dad,” Mayor Michael Bloomberg said during the service. “How much you must miss him. Your father died a hero.”

The 47-year-old was posthumously promoted to detective, first-class.

“Knowing your father was a hero, however, doesn’t make it any easier these days,” Bloomberg said. “Knowing your dad was revered in the NYPD doesn’t make his passing less painful.”

The casket holding Figoski’s body was led into the small Roman Catholic church in Babylon by a processional of bag pipes and drums playing “Amazing Grace.” His daughters trailed behind.

Uniformed officers from the NYPD, Suffolk, and Nassau departments, state police from New York and New Jersey, and officer from upstate New York communities lined up to pay respect. It was so crowded that some officers stood on the nearby Long Island Railroad platform.

Figoski was working midnights in the 75th Precinct in the East New York neighborhood and was responding to a report of break-in at a Brooklyn apartment Dec. 15.

He was shot once in the face and died hours later at a hospital.

Lamont Pride and four others are accused of trying to rob a marijuana dealer in the basement apartment. When they allegedly smashed in the door and began beating the dealer, the upstairs owner of the home called 911.

Figoski and his partner were providing backup to two officers questioning the victim and two suspects in the apartment when Pride and another man tried to flee, police said. During a struggle between the officer’s partner and one of the suspects, Figoski came face-to-face with Pride, who police said shot him with a semiautomatic handgun before Figoski could draw his own weapon.

His partner pursued Pride on foot and captured him several blocks away, police said.

Pride is charged with first-degree murder. The other four are charged with second-degree murder.

Prosecutor Kenneth Taub said the five ? all jailed without bail ? had plotted to “commit a home invasion of a small-time marijuana dealer.” He called Pride the “muscle of the organization” and said the defendant “made a choice to end the officer’s life rather than be arrested.”

Pride was already wanted in a non-fatal shooting in North Carolina but remained on the streets because arrest warrants didn’t require his return there, NYPD officials said.

He had been arrested twice in recent months in New York for weapons and drug possession. Each time, he was released after police found they had no grounds to hold him under the North Carolina warrants, Kelly said.

Pride also served a short prison term in North Carolina for robbery.

19 DecRapper’s slaying in Ga. music studio investigated

Atlanta police are continuing to try to piece together what led to the slaying of rapper Slim Dunkin, who was gunned down Friday evening in a city music studio as he was preparing to record a video.

Police Sgt. Curtis Davenport said in an email late Saturday that no arrests had been made in the killing, but he declined to say whether investigators had identified any suspects.

Police Maj. Keith Meadows said Friday that the rapper, whose real name is Mario Hamilton, was fatally shot in the chest after getting into an argument with another individual that evening. He was transported to a city hospital where he was pronounced dead.

Meadows said then that police had not identified the shooter and witnesses had given varying accounts.

28 OctHours after release, Michael Lohan back in jail

The estranged father of actress Lindsay Lohan was back in police custody Thursday, hours after being released from a Tampa jail on domestic violence charges.

Tampa police responded to a 911 call from Michael Lohan’s on-and-off girlfriend early Thursday. Kate Major told police Lohan, 51, made a harassing phone call to her shortly after being released from jail Wednesday afternoon.

Lohan called again while police were at Major’s condo. Major, 28, put the call on speaker so police could listen. After hearing what Lohan said, the police department notified the Hillsborough County State Attorney’s Office of a violation of Judge Walter Heinrich’s pre-trial release orders that he stay away from Major and an arrest order was authorized.

Police went to the Tahitian Inn in Tampa, where Lohan was reportedly staying. According to a news release from police, Lohan spotted the officers and jumped off a third-floor balcony in an attempt to escape.

Lohan was arrested after a short pursuit on foot. He was taken into police custody and taken to the Hillsborough County Jail. There, deputies suspected he may have broken his foot when he jumped off the balcony, so he was taken to Tampa General Hospital for evaluation.

Authorities said he will be returned to the jail once he’s been cleared by doctors.

Lohan was arrested Tuesday on domestic violence charges involving Major, a former reporter for the Star tabloid. Police say he grabbed her arms and pushed her down multiple times during a daylong argument. When Lohan was released from jail Wednesday, he said he “didn’t do anything” and the charges were Major’s way of making money.

The St. Petersburg Times reported that Lohan claimed Major set him up to be overheard by police Thursday. “She needs help, she calls me, and I’m a sucker so I call her back. I’m an idiot,” Lohan said as he was being put into the back of a police cruiser.

In July, a misdemeanor domestic violence charge against Lohan stemming from a fight with Major was dismissed in Los Angeles after she failed to show up for the trial. Lohan’s attorney said Major declined to cooperate to avoid a court spectacle.

Lohan has a history of arrests in New York over allegations of harassment from ex-girlfriends.

Meanwhile, his daughter Lindsay Lohan could also return to jail in California after a judge last week ruled she violated probation involving a community service assignment. A Nov. 2 court date was set to decide whether Lindsay Lohan should be jailed.

The 25-year-old actress was given probation for a 2007 drunken driving case and a misdemeanor theft case this year.

Criminal Law

With the number of police procedurals and other similar shows on television today, most of us probably think we?re familiar with criminal law. We think we know how the legal process works, and what we should do if we?re ever confronted by the police, arrested, or, worse yet, charged with a crime. Unfortunately, like most things on television, the portrayals on these shows aren?t entirely accurate.

What to Do in Case of an Encounter with the Police

If the police approach you either in or away from your home, the first thing you should do is remain calm. Any erratic or abusive behavior toward the police will only make your situation worse. You should also be aware that unless the police have a warrant, they are not allowed to enter your home except under very specific circumstances. They are also not allowed to search your car, although the guidelines here are a bit more lenient.

]]>

Some circumstances under which the police might be justified in entering your home without a warrant include:

The police have reason to believe someone inside your house is in immediate danger The police feel that you are a flight risk There is reason to believe evidence within the house might be compromised if they don?t make immediate entry

Similar rules exist for entering or searching your car. If the police do enter your home or search your vehicle without a warrant, be sure your lawyer is aware of the circumstances, as this could be a major factor in your favor if your case goes to trial.

During any conversation with or in the presence of the police, do not make any statements that could be construed as an admission of guilt. In fact, if you?ve been charged with a crime and are arrested, any conversations with authorities are best saved until you can have a lawyer present.

How to Find a Good Criminal Lawyer

An experienced criminal lawyer can help you navigate your way through the complex legal system you?ll have to face if you?re accused of a crime. A good lawyer can make the difference between a permanent black mark on your record and a ?not guilty? verdict or even a dismissal of your case. When you?re looking for a lawyer to represent you, look at their past history and how cases they?ve handled have been settled. Extensive experience and a high number of ?not guilty? verdicts indicate a lawyer who can give you the help you need to deal with your situation.

08 OctAustralia gives priority to returning boy suspect (AP)

CANBERRA, Australia ? Australia has given top priority to securing the return of a 14-year-old boy arrested in Indonesia for alleged marijuana possession in a challenging case that will require patience to resolve, the foreign minister said Friday.

The boy, whose name has been published in the media but not yet officially released, has been held at Denpasar police headquarters on the tourist island of Bali since he was arrested Tuesday after allegedly buying a small quantity of marijuana from a man on Kuta Beach.

His lawyer, Muhammad Rifan, said the boy faces a maximum sentence of six years in an adult prison if convicted of possessing a quarter of an ounce (7 grams) of marijuana, which under Indonesian law is treated the same as heroin or cocaine.

Foreign Minister Kevin Rudd said he told Australia’s ambassador to Indonesia, Greg Moriarty, to go to Denpasar and give the case top priority.

“My job as foreign minister is to do everything possible to get this little bloke home,” Rudd told radio station 3AW in the southern city of Melbourne.

“There are real challenges that we face here, and I think we’ve all got to be patient,” he said. “This is going to take some time.”

Prime Minister Julia Gillard described the boy’s incarceration as “an incredibly distressing circumstance.” She said the boy was being held apart from other prisoners.

The boy, from Morrisset Park, north of Sydney, was on vacation with his parents when he was arrested.

Rudd said the boy’s parents had taken turns to spend Thursday night with their son at the police jail. Rudd declined to comment on the boy’s condition.

Rifan said the boy was angry, crying and depressed in custody. He can be held for 30 days without charge.

The arresting police officers broke Indonesian rules for dealing with child suspects by not allowing the boy’s parents to be present during his interview, Rifan said.

Because of this, police agreed to re-interview the boy Friday and have him take a new urine test for drugs.

Julian McMahon, a Melbourne lawyer representing two Australians on death row in Bali for smuggling heroin in 2005, said the boy need not fear the maximum six-year sentence.

“He would get nothing like that. He would get some months, you would expect, if he had to go to jail at all,” McMahon told Australian Broadcasting Corp. radio.

Rifan said the boy could avoid a prison term if he could prove he had a drug addiction for which he had been receiving counseling in Australia.

Australian media have reported the boy is the youngest Australian to be arrested under Indonesia’s tough drug laws.

The Sydney Morning Herald newspaper reported Friday that the boy told police he bought the marijuana for 250,000 rupiah ($28) because he felt sorry for the alleged dealer who said he had not eaten for a day.

McMahon said most foreigners are arrested in these circumstances when they buy drugs from police informants.

Indonesia has some of the world’s strictest drug laws and people convicted of smuggling or possessing drugs are often executed by firing squad. More than 140 prisoners are on death row in Indonesia, including more than 50 foreigners.

18 Jun6 shot on Baltimore porch; 1 dead, 2 critical (AP)

BALTIMORE ? Baltimore police had dealt with plenty of complaints at the spot where one or two gunmen sprayed bullets at six men sitting on a porch Thursday, killing one and critically wounding two others, the city’s police commissioner said.

“Mostly complaints about drinking and drugs, drinking and drugs,” Police Commissioner Frederick Bealefeld said. He added, “We’re not operating in the dark here, our officers have conducted many enforcement actions there.”

He said police were familiar with the victims too, some of whom had arrest records.

The men on the porch ranged in age from 28 to 72, including the unidentified victim who was pronounced dead at the scene, Bealefeld said.

Two others were in critical condition at the University of Maryland Shock Trauma Center while the others suffered non-life-threatening injuries, police spokesman Anthony Guglielmi said.

The six were on a porch when one, maybe two, gunmen, walked down an alley next to the house, opened fire and fled back down the alley, Bealefeld said.

Neighbor Charles Toy, who lives down the street, said drug dealing was common in the neighborhood, but gunfire was not.

“No, we’re surprised by this,” Toy said. “But this is over drugs. All of the ones that got shot, they probably know each other, even the ones that shot them.”

Tony Johnson said he was walking down Edmondson Avenue when he heard gunfire. When he looked around the corner, Johnson said he saw the victims sprawled around in front of the house.

“Five or six shots, sounds like it was a big gun, whatever it was,” Johnson said.

Johnson said he lives about six blocks away and drug dealing and other crimes are not uncommon in the neighborhood.

Several neighbors blamed the problems on dealers from outside the neighborhood who use the area.

Later in the day at a news conference at police headquarters, Mayor Stephanie Rawlings-Blake echoed that theme.

“The people who live there and love their community are not the ones that are creating this havoc,” Rawlings-Blake said. “People that are coming in from outside the neighborhood are causing problems.”

The mayor and police commissioner asked neighbors to help them put an end to the violence, a perennial issue in the city where prosecutors struggle against witness intimidation.

“Someone knows who did this, someone knows why,” Rawlings-Blake said.

Bealefeld said police “needed to know the why of it,” and would put the resources necessary into the neighborhood west of downtown to find the gunmen.

“This is senseless, this is senseless, no one should be solving disputes in the city in this way. No one should be running around with guns, gunning down six people in the middle of the afternoon,” the police commissioner said.
